Constitution

Adopted March 2, 1992 and Revised September 3, 1996

We, the undersigned, wishing to secure for ourselves the pleasures and benefits of the association of persons commonly interested in Amateur Radio, do hereby constitute ourselves the Murray State University Amateur Radio Club, hereinafter referred to as the Club or MSUARC, and enact this Constitution as our governing law. It shall be our purpose to facilitate the exchange of fraternalism and individual operation efficiency, and to so conduct club programs and activities as to advance the general interest and welfare of Amateur radio in the general community.

Article I

Section 1: All persons interested in Amateur Radio (an individual interested in the radio technique solely with a personal aim and without pecuniary interest) shall be eligible for membership. Membership shall be by application and election upon such terms as the Club shall provide.

Section 2: Applications for membership shall be submitted at a regular meeting in writing and each application must express the willingness of the applicant to abide by the Constitution and Bylaws and such rules as shall from time to time be promulgated by the club. There shall be two classes of membership:

a. Full - Applicant must be associated with Murray State University as Faculty, Staff, or an enrolled student, possesses an Amateur license, serve a 30- day apprenticeship as an Associate member, desire to participate actively in club activities, and must obtain majority approval by all active full members present at a regular meeting. Privileges: Key to station, use of station facilities and repeater to extent of license class, and full participation in club activities.

b. Associate - Applicant must be interested in Amateur Radio and obtain majority approval by all active members present at a regular meeting. Privileges: Use of station facilities and repeater to extent of license class, and participation in club activities as desired.

c. In addition, the club may invite former members or other persons who wish to support the MSUARC to contribute and participate as they wish, as supportive non-members.

A member shall have either active or inactive status. A member will become inactive for failure to pay dues for the current year. An inactive member can be reinstated as an active member by payment of dues during the year on which that member became inactive; after that year, a new application for membership is required.

Article II

Section 1. The officers of this Club shall be: A President, a Vice - President, Secretary, and a Treasurer.

Section 2. The officers of this Club shall be elected for a term of one (1) year by a majority ballot of all active members present at the regular monthly meeting in April. Candidates for office must be active full members of the club.

Section 3. Vacancies occurring between elections must be filled by a special ballot, at the first regular meeting at which the withdrawal or resignation is announced.

Section 4. Officers may be removed on motion by a three-fourths vote of the active membership.

Article III

Section 1. The President shall preside at all meetings of the Club and conduct the same according to the rules adopted; enforce due observance of this Constitution and Bylaws; decide all questions of order; sign all official documents that are adopted by the Club; perform all customary duties pertaining to the office of President.

Section 2. The Vice - President shall assume all the duties of the President in absence of the President.

Section 3. The Secretary shall keep a record of the proceedings of all meetings; keeps a roll of members; submit applications for membership; carry on correspondence; read correspondence received at each meeting; mail written notices to each member of any special meetings, when necessary. It shall be the duty of the Secretary to keep the Constitution and Bylaws of the Murray State University Amateur Radio Club and have the same present at every regular and special meeting. The Secretary shall cause all amendments, changes, and additions to be noted thereon and shall permit the same to be consulted by the members upon request.

Section 4. The Treasurer shall receive and receipt for all moneys received and expended; pay recurring bills, once authorized, as received without the need for additional approval; maintain a petty cash fund not to exceed $ 25.00 and to replenish this fund as required to maintain it at $ 25.00. Expenditures from this fund will require the same receipts as the regular account. Before the end of each yearly term of office, the Treasurer shall submit an itemized statement of disbursements and receipts. At the expiration of the Treasurer's term of office, the outgoing treasurer shall turn over everything in his possession belonging to the club to his successor.

Section 5. The officers herein defined, in consultation with the Faculty Sponsor and Station Trustee when appropriate, constitute an Executive Council. The Executive Council will meet as needed to organize and plan the meeting agendas and suggested club activities. The Executive Council may authorize the Treasurer to disburse for purchases up to $ 50.00 between consecutive meetings of the Club. Such purchases will be reported to the general membership at the next meeting. All actions of the Executive Council are subject to review and approval of the membership.

Article IV

The Bylaws shall provide for regular and special meetings. At meetings, one-third of the active membership shall constitute a quorum for the transaction of business.

Article V

The Murray State University Amateur Radio Club, by two-thirds vote of those present at any regular meeting, may levy upon the general active membership such dues or assessments as shall be deemed necessary for the business of the organization within the objectives set forth in the preamble thereof. Non-payment of such dues or assessments shall be cause for expulsion from the activity, within the discretion of the active membership.

Article VI

The Club shall enact appropriate rules to minimize interference in operation between stations of its members; it shall formulate adequate plans for disposition of any cases of interference to other radio services where reported as caused by any Amateur station operation in the area of the Club's jurisdiction. The Club, through designated committees, will provide technical advice to members concerning equipment design and operation to assist in radiations from Club member stations. The Club shall also maintain a program to foster and guide public relations in those channels favorable to Amateur work.

Article VII

This Constitution may be amended by a two-thirds vote of the active members present at a regular meeting. Proposals for amendments shall be submitted in writing at a regular meeting and may not be voted on until the next regular meeting.

Article VIII

The Club shall abide by all rules and regulations as set forth by the Federal Communications Commission. Any member may be removed from the Club for violation of the Club constitution, University regulations, and/or violation of Federal Communications Commission regulations, by a three-fourths vote of the active membership.

Article IX

Robert's Rules of Order shall govern proceedings.

Article X

Section 1. All actions and activities of this Club are to be subject to review and approval of the Station Trustee and Faculty Sponsor.

Section 2. The Faculty Sponsor shall be selected jointly by Murray State University and the MSUARC. The Sponsor should be an active radio amateur, and must be a member of the Murray State University faculty. The Faculty Sponsor will aid and guide the Club as expected by Murray State University.

Section 3. The Station Trustee shall be appointed by the Faculty Sponsor. The Trustee must be an active radio amateur of General class or higher and an active full member of the MSUARC. The Station Trustee is responsible to the Federal Communications Commission for the correct and legal operation of the club stations, and will aid and guide the Club to effect this end.
